Sudovi u Srbiji gotovo da su paralisani ogromnim brojem predmeta u kojima građani tuže banke za troškove obrade kredita. Reč je o desetinama hiljada tužbi, a strukovna udruženja sudija i tužilaca već traže od države da se pronađe rešenje za ovaj problem.

Dušan Marković iz Jagodine tužio je svoju banku za naplaćene troškove obrade kredita. Smatra da je u pravu i da banka osim kamate nije imala osnova da naplati ništa drugo. Pronašao je ugovore, angažovao advokata i nada se da će spor sa bankom biti brzo rešen.

“Prvo nam naplaćuju najveće kamate u Evropi, a još preko toga ti naplate neki trošak obrade koji je nezakonit, neustavan, kako god hoćete, tako da nema smisla”, ističe Dušan Marković, podnosilac tužbe.

U parničnim odeljenjima sudova koja postupaju u prvom stepenu pojačan je priliv novih predmeta protiv banaka. 

“U 2020. godini podneta je 191 tužba od strane građana protiv više banaka od toga je u 22 predmeta postupak okončan donošenjem presuda u korist građana, tako da u ovom sudu nema nijedne presude koja je doneta u korist banaka”, navodi Jasmina Tašković, sudija.

Zastupanjem građana u predmetima protiv banaka bave se advokati, razna udruženja i agencije i gotovo svi gradovi oblepljeni su obaveštenjima kome se javiti. Poslednjih dana krenulo je i nasumično pozivanje građana telefonom s pitanjem – da li ste imali kredit? Zastupnici se obično naplaćuju po pravosnažnosti presude od strane koja izgubi spor.

“Banke nisu kod svakog klijenta naplaćivale trošak obrade, ali u većini slučajeva jesu. Tamo gde je naplaćen taj trošak obrade klijenti treba da imaju ugovor o kreditu gde se to vidi i to je osnov za podnošenje tužbe”, objašnjava Ivan Milošević, advokat.

Strukovno Udruženje sudija i tužilaca zatražilo je od Vlade da učestvuje u rešavanju ovog pitanja na brz i pogodan način, jer realno preti blokada sudova.

“Svi sudovi svih nivoa u Srbiji su u ozbiljnoj opsadi zbog ovih predmeta. Da ne budem pogrešno shvaćena, građani imaju pravo da svoje pravo zaštite pred sudom, ali sud je to pitanje rešio, sada treba naći pogodan način da se prevaziđe ova situacija blokade rada sudova”, naglašava Ivana Josipović, predsednica UO Udruženja sudija i tužilaca.

Banke kažu da nema pravnog osnova za tužbe i često se žale drugostepenim sudovima. Ističu da je klijent pre potpisivanja ugovora bio upoznat sa uslovima i da naknade za troškove obrade postoje i u inostranstvu.

Ima i pokušaja da se klijenti vansudski nagode sa bankom. Pojedinačne cifre često nisu velike, ali u ukupnom zbiru, prema računicama udruženja potrošača, banke su na ime troškova obrade kredita naplatile više od 10 milijardi dinara.

Sudovi u Srbiji gotovo da su paralisani ogromnim brojem predmeta u kojima građani tuže banke za troškove obrade kredita. Reč je o desetinama hiljada tužbi, a strukovna udruženja sudija i tužilaca već traže od države da se pronađe rešenje za ovaj problem.

Dušan Marković iz Jagodine tužio je svoju banku za naplaćene troškove obrade kredita. Smatra da je u pravu i da banka osim kamate nije imala osnova da naplati ništa drugo. Pronašao je ugovore, angažovao advokata i nada se da će spor sa bankom biti brzo rešen.

“Prvo nam naplaćuju najveće kamate u Evropi, a još preko toga ti naplate neki trošak obrade koji je nezakonit, neustavan, kako god hoćete, tako da nema smisla”, ističe Dušan Marković, podnosilac tužbe.

U parničnim odeljenjima sudova koja postupaju u prvom stepenu pojačan je priliv novih predmeta protiv banaka. 

“U 2020. godini podneta je 191 tužba od strane građana protiv više banaka od toga je u 22 predmeta postupak okončan donošenjem presuda u korist građana, tako da u ovom sudu nema nijedne presude koja je doneta u korist banaka”, navodi Jasmina Tašković, sudija.

Zastupanjem građana u predmetima protiv banaka bave se advokati, razna udruženja i agencije i gotovo svi gradovi oblepljeni su obaveštenjima kome se javiti. Poslednjih dana krenulo je i nasumično pozivanje građana telefonom s pitanjem – da li ste imali kredit? Zastupnici se obično naplaćuju po pravosnažnosti presude od strane koja izgubi spor.

“Banke nisu kod svakog klijenta naplaćivale trošak obrade, ali u većini slučajeva jesu. Tamo gde je naplaćen taj trošak obrade klijenti treba da imaju ugovor o kreditu gde se to vidi i to je osnov za podnošenje tužbe”, objašnjava Ivan Milošević, advokat.

Strukovno Udruženje sudija i tužilaca zatražilo je od Vlade da učestvuje u rešavanju ovog pitanja na brz i pogodan način, jer realno preti blokada sudova.

“Svi sudovi svih nivoa u Srbiji su u ozbiljnoj opsadi zbog ovih predmeta. Da ne budem pogrešno shvaćena, građani imaju pravo da svoje pravo zaštite pred sudom, ali sud je to pitanje rešio, sada treba naći pogodan način da se prevaziđe ova situacija blokade rada sudova”, naglašava Ivana Josipović, predsednica UO Udruženja sudija i tužilaca.

Banke kažu da nema pravnog osnova za tužbe i često se žale drugostepenim sudovima. Ističu da je klijent pre potpisivanja ugovora bio upoznat sa uslovima i da naknade za troškove obrade postoje i u inostranstvu.

Ima i pokušaja da se klijenti vansudski nagode sa bankom. Pojedinačne cifre često nisu velike, ali u ukupnom zbiru, prema računicama udruženja potrošača, banke su na ime troškova obrade kredita naplatile više od 10 milijardi dinara.
